THE MONTGOMERY CASE. The case of George Weatherby against the Capital City Water Company, of Montgomery, Ala., asking that the City court appoint receivers was finally decided this morning by the Supreme court which affirms the opinion of the lower court, which has decided there was no equity in the bill for receivers The Supreme court holds that the claim of $100, said to have been owed Weathcrby by the company was not sufficient to put property valued at several hundred thousand dollars into the hands of the courts; that if the suit had equity it should have been brought against the trustees of the property, who were made the custodians by the statute after the charter was annulled, and that Weatherby shows no interest as a citizen which would warrant the appointment of a receiver on his petition.
