WATERWORKS LITIGATION. FERGUS FALLS, MINN. Judge Amidon has declined to grant the temporary injunction asked for by the Fergus Falls Water Works company in the United States court, to restrain that city from continuing the condemnation of the dam, which supplies the waterworks with power. The company attacked the constitutionality of the provisions of the city charter, which provides for the appointment of three Fergus Falls citizens to act as appraisers in condemning property to he taken for public use. and the judge made some observations on the subject that this was equivalent to permitting a man to act as judge and jury in his own case. While not passing on this point directly, he intimated that the company’s remedy was to come into court and appeal from the award of the commissioners, and stated that he would see that justice was done in the premises.
