THE POSITION OF COMMISSIONER GRAINGER. Charles F. Grainger, of the State racing com mittee and a member of the Louisville, Ky., board of waterworks, has been asked by the mayor of that city to resign from the latter body. The mayor calls attention to section 165 of the constitution of Kentucky, which provides that a State official cannot hold a city and county office simultaneously, He cites a number of an thorities to show that Mr. Grainger’s position on the State racing commission has been construed as a State office, and that this contention was made in the case of Grainger vs. the Douglas Park Jockey club, which was tried in the Federal court at Louisville two years ago.
