Water Works Suit at Youngstown. The Circuit Court has unanimously affirmed the decision of the Common Pleas court in the appeal of the city of Youngstown, Ohio, of its suit with the Mahoning & Trumbull Water company. The lower court had ruled that the water company had prior right to appropriate land at the proposed Berlin reservoir site, where the city had spent thousands of dollars on its proposed reservoir. The new decision places the municipality at the mercy of the water company on this proposition. Upon the question of the constitutionality of the right of a private corporation to hold its land free from appropriation, the court held with the Supreme court in favor of the water company’s contention.
