Water Works Litigation. Judge Hammond, of the Massachusetts Supreme Court has refused to issue a writ of mandamus on a petition of George I. M. Hayes against the water commissioners of Chelsea to compel the latter to turn on the water supply and install a meter in his house. The water was shut off January 25. The meter system is in use in Chelsea. The law provides that the meters shall lie installed and taken care of, but does not state who shall take care of them. The water commissioners adopted a rule providing that the consumers shall take care of their meters. The rule also provides that a charge shall be made for repairing. The petitioner’s meter was put out of order as a result of the wrater freezing. The water department would not repair the meter unless Haves paid $2 for the work. He claimed that the duty…
