Deposed Terre Haute Chief Gets Retrial. The Appellate Court has reversed the decision of the Parke County (Ind.) Circuit Court in the case of Elias F. Leonard against the city of Terre Haute and remanded the case back to Vigo County for retrial. Suit was brought by Leonard against the city for damages and back pay, following his discharge as chief of the fire department by the Board of Public Safety. He charged in his complaint that he was dismissed for political reasons and without being given the right of a hearing before the board. 3 he higher court sustained both allegations of the plaintiff on the ground that they had been established thoroughly and held that the defendant had failed to controvert.
