Waterworks Litigation. The Butte. Mont., Water Company has brought suit against the city to recover $10,405.75. alleged to be due for four months’ rental of fire hydrants, and for six months’ use of water for sprinkling, flushing sewers and for labor, material, etc., furnished the city. The bills have not been paid in consequence of an opinion given by City Attorney Maury that the contract requires the water company to supply all water used by the city for the rental paid for the 450 fire hydrants at $50 a year. This contract was made four years ago. lhe company disputes the construction put on the contract by the city attorney, hence the suit. The administrator of James M. Strader, who was killed at the reservoir of the Lexington, Ky., Water Company, by an employe of the company, cannot recover damages from the company for the death. The Court of Appeals…
