Decision in Owensboro Case An opinion has been handed down by Federal Judge Walter Evans, of Louisville, Ky., enjoining the City of Owensboro from molesting the Owensboro Water Works Company, which is seeking to lay water mains in the streets. The council passed an ordinance prohibiting the company from laying water mains. An injunction was secured to prevent the ordinance from going into effect. Judge Evans has declared the ordinance void as the water company holds a perpetual franchise. The city will take the case to the Supreme Court. The city has its own municipal water plant, and has been in litigation with the private company for many years.
