OPINION RELATIVE TO WILKESBARRE FIREMEN’S RELIEF ASSOCIATION. An opinion and decree granting an amendment to the charter of the Wilkes-Barre (Pa.) Firemen’s Relief Association, which shuts out from membership and benefits tha former call men of the fire department, who had been members until the department became a paid force, was recently handed down by Judge Woodward, the Court holding that under the constitution and by-laws of the Wilkes-Barre Firemen’s Relief Association membership in the fire department is a necessary requirement to membership in the association. The call men objected to any change in the charter that would exclude them from its benefits on the principal ground that the call men had contributed to the fund, but the court states that the amendment does not prejudice their rights to test this question in another proceeding.
