Judge Dismissed Lawsuit by Family of Baltimore (MD) Fire Cadet Killed in Training

A federal judge has dismissed a $15 million lawsuit filed by the family of a Baltimore (MD) fire cadet who was killed in a live fire training evolution in 2007.

On Friday, Judge Benson Everett Legg ruled that Racheal Wilson could have opted out of the training and that the exercise does not create grounds for a federal civil rights suit. He also noted that Wilson’s family still had rights under workers’ comp law and other areas, accoridng to The Baltimore Sun‘s blog.

Wilson, a young mother, died during live fire training at an acquired structure on February 9, 2007. According to the NIOSH report on the incident, Wilson was operating the nozzle on a four-person engine company seeking to make an initial attack on a fire in a vacant, condemned townhouse. She became stuck while attempting to exit the window after conditions in the structure became untenable. The autopsy report listed the victim’s cause of death as thermal injuries and asphyxia.
