A Wisconsin Water Suit.
The suit of Mary A. Edwards and Charles P. Lawrence vs. City of Cheyenne and others, is a prayer for a temporary writ of injunction restraining and enjoining the city of Cheyenne, Wyo., its officers, agents and employees, from trespassing upon the lands of said plaintiffs during the life of this injunction, and from erecting or constructing any buildings or erections of any kind upon said land or any part thereof, and asking that the defendants be enjoined from pursuing the condemnation of said land or from appearing or insisting upon any further hearing of said matter before said appraisers or otherwise, and that upon final hearing said injunction be made permanent. The petition further prays that the board of appraisers be enjoined from making any investigation, or taking any testimony or evidence as to the value of such land, or as to the damage that plaintiffs might suffer by reason of the taking of said land by the city. This will have the effect of stopping all proceedings in the matter until the injunctions is disposed of, which because of its importance to the city and taxpayers, will probably be heard at once The suit is in connection with the condemnation proceedings against the land to he occupied by the Crystal Lake dam. The site of the darn is located on land owned by Mary A. Edwards and Charles P. Lawrence. Sometime ago the city made an offer for the land of $1,600. This was refused and a board of appraisers was appointed to condemn the land and assess the damages to the property owners. This cannot now be proceeded with.
