NEW CHESTER WATERWORKS IN LITIGATION.
The papers have been served upon Mayor William H. Berry and City Clerk Frank W. Harrison, by the New Chester, Pa., Water company. in an action whereby the Water companywill sue to recover the sum of $3,136.27 for six months’ water rent claimed to have been due in July last. The suit grows out of City Comptroler William Ward, jr., refusing to sign the warrant for the payment of the sum named, at that time the question having been raised by prominent citizens that there was no clause in the city contract with the water company, providing for fire protection, the schedule of rates stating that the rate for flushing of fire plugs be $40 per year each. The claim was that the water company has not flushed the fire hydrants, and through mandamus proceedings, the city comptroler was restrained from signing the warrant.
